be rejected if the documentation is incomplete, the contractor fails to show that it meets certain conditions or responds incorrectly to a request from the contracting authority.<\/p><p class=\"isSelectedEnd\">Our firm supports entrepreneurs in matters concerning <strong>public procurement law<\/strong> \u2013 from analysing the tender documentation and preparing the tender, through certain requirements are proportionate to the subject of the contract and whether they restrict competition in a way that may require a response from the contractor.<\/p><h4 style=\"text-align: left;\">Preparing a tender in public procurement<\/h4><p class=\"isSelectedEnd\">Preparing a tender is not just about entering a price and sending documents.<\/p><p class=\"isSelectedEnd\">Depending on the procedure, the contractor may be required to demonstrate experience, the availability of certain staff, appropriate licences, its economic or financial standing or other resources needed to perform the contract.<\/p><p class=\"isSelectedEnd\">We help check whether the documentation prepared by the contractor meets the contracting authority\u2019s requirements and whether the information in the individual documents is consistent.<\/p><p class=\"isSelectedEnd\">We also support contractors relying on the experience or resources of other entities and entrepreneurs who want to bid for a contract jointly.<\/p><h4 style=\"text-align: left;\">Consortia and relying on the resources of other entities<\/h4><p class=\"isSelectedEnd\">Not every entrepreneur has to meet all the requirements of the procedure on its own.<\/p><p class=\"isSelectedEnd\">In certain situations, contractors may bid jointly by forming a consortium or rely on the resources of other entities.<\/p><p class=\"isSelectedEnd\">However, such solutions require properly prepared documentation and a correct definition of the scope of each entity\u2019s participation in performing the contract.<\/p><p style=\"text-align: left;\">Questions and clarifications on the SWZ<\/h4><p class=\"isSelectedEnd\">If the tender documentation is unclear or contains questionable requirements, the contractor should not wait until submitting its tender.<\/p><p class=\"isSelectedEnd\">At the appropriate stage of the procedure, questions on the content of the procurement documents can be sent to the contracting authority.<\/p><p class=\"isSelectedEnd\">We help prepare questions and requests for clarification of the SWZ, especially where doubts concern the conditions for participation, the description of the subject of the contract, tender evaluation criteria or the draft contract provisions.<\/p><p class=\"isSelectedEnd\">A well-prepared question can not only clarify an ambiguity but also draw the contracting authority\u2019s attention to provisions that need to be changed.<\/p><h4 style=\"text-align: left;\">Explanations and supplementing documents<\/h4><p class=\"isSelectedEnd\">During the procedure, the contracting authority may ask the contractor to submit additional documents, supplement them or explain certain information.<\/p><p class=\"isSelectedEnd\">The way the contractor responds may directly affect its further participation in the procedure.<\/p><p class=\"isSelectedEnd\">We help prepare responses to the contracting authority\u2019s requests, including those concerning:<\/p><ul data-spread=\"false\"><li style=\"text-align: left;\">subjective evidence,<\/li><li style=\"text-align: left;\">the content of the tender submitted,<\/li><li style=\"text-align: price lower than competitors\u2019 prices does not in itself mean the tender is incorrect. It may, however, lead the contracting authority to ask the contractor for detailed explanations.<\/p><p class=\"isSelectedEnd\">In such a case, it is important to properly demonstrate what the price offered is based on and why it allows the contract to be performed properly.<\/p><p class=\"isSelectedEnd\">We help prepare explanations concerning an <strong>abnormally low price<\/strong>, analyse the contractor\u2019s calculations and documents and assess what information should be presented to the contracting authority.<\/p><p class=\"isSelectedEnd\">We also help when doubts concern the price offered by a competitor.<\/p><h4 style=\"text-align: left;\">Selection of the tender and analysis of the competition<\/h4><p class=\"isSelectedEnd\">Once the information on the selection of the most advantageous tender has been published, it is worth checking not only the result of the procedure, but also the grounds on which it was based.<\/p><p class=\"isSelectedEnd\">If the client\u2019s tender was not selected, we analyse the procedure documentation and \u2013 to the extent possible \u2013 the tender of the selected contractor.<\/p><p class=\"isSelectedEnd\">We check, among other things, whether:<\/p><ul data-spread=\"false\"><li style=\"text-align: left;\">the contractor met the conditions for participation,<\/li><li style=\"text-align: left;\">there were no grounds for excluding it,<\/li><li style=\"text-align: left;\">the tender submitted met the requirements of the SWZ,<\/li><li style=\"text-align: left;\">the contracting authority applied the tender evaluation criteria correctly,<\/li><li style=\"text-align: left;\">the tender should not have been rejected,<\/li><li style=\"text-align: left;\">the contracting authority\u2019s actions were carried out in accordance with the law.<\/li><\/ul><p class=\"isSelectedEnd\">If we find grounds to challenge the result of the procedure, we analyse the possibility of using legal remedies.<\/p><h4 style=\"text-align: left;\">Appeal to the National Appeal Chamber<\/h4><p class=\"isSelectedEnd\">Public procurement procedures are conducted within a specific procedural framework. If the contracting authority breaches the rules, the contractor may in appropriate cases file an <strong>appeal to the National Appeal Chamber (KIO)<\/strong>.<\/p><p class=\"isSelectedEnd\">An appeal may concern, among other things:<\/p><ul data-spread=\"false\"><li style=\"text-align: left;\">the content of the procurement documents,<\/li><li style=\"text-align: left;\">the conditions for participation in the procedure,<\/li><li style=\"text-align: left;\">rejection of the tender,<\/li><li style=\"text-align: left;\">exclusion of the contractor,<\/li><li style=\"text-align: left;\">selection of a competitor\u2019s tender,<\/li><li style=\"text-align: left;\">failure to reject another contractor\u2019s tender,<\/li><li style=\"text-align: left;\">other actions or omissions of the contracting authority affecting the result of the procedure.<\/li><\/ul><p class=\"isSelectedEnd\">Deadlines are very important in KIO cases, so after receiving an unfavourable decision from the contracting authority it is worth assessing the available options as quickly as possible.<\/p><h4 style=\"text-align: left;\">Representation before the KIO<\/h4><p class=\"isSelectedEnd\">Our firm prepares appeals and represents contractors in proceedings before the <strong>National Appeal Chamber<\/strong>.<\/p><p class=\"isSelectedEnd\">We analyse the procedure documentation, formulate allegations and requests and prepare arguments and evidence.<\/p><p class=\"isSelectedEnd\">We also help contractors who want to join appeal proceedings on the side of the contracting authority or another contractor, if the outcome of the KIO proceedings may affect their interests.<\/p><h4>Public procurement contract<\/h4><p class=\"isSelectedEnd\">Winning the procedure does not end the legal issues related to the contract.<\/p><p class=\"isSelectedEnd\">The next stage is concluding and performing the contract, whose terms largely follow from the documentation prepared earlier by the contracting authority.<\/p><p class=\"isSelectedEnd\">Before the contract is signed, we analyse, among other things:<\/p><ul data-spread=\"false\"><li style=\"text-align: left;\">the contractor\u2019s obligations,<\/li><li style=\"text-align: left;\">completion deadlines,<\/li><li style=\"text-align: left;\">the rules for acceptance of works, supplies or services,<\/li><li style=\"text-align: left;\">contractual penalties,<\/li><li style=\"text-align: left;\">the contractor\u2019s liability,<\/li><li style=\"text-align: left;\">payment terms,<\/li><li style=\"text-align: left;\">the rules for indexation of remuneration,<\/li><li style=\"text-align: left;\">the possibility of amending the contract,<\/li><li style=\"text-align: left;\">the grounds for withdrawal from or termination of the contract.<\/li><\/ul><p class=\"isSelectedEnd\">Such an analysis is worth carrying out already at the procedure stage, because some contract provisions may significantly affect the profitability of the whole contract.<\/p><h4 style=\"text-align: left;\">Amending the contract during performance<\/h4><p class=\"isSelectedEnd\">During the performance of the contract, circumstances may arise that the parties did not foresee when submitting tenders.<\/p><p class=\"isSelectedEnd\">Public procurement law limits the possibility of freely amending the contract, but in certain situations allows it to be modified without a new procedure.<\/p><p class=\"isSelectedEnd\">We help assess whether, in a specific situation, it is possible to change, among other things:<\/p><ul data-spread=\"false\"><li style=\"text-align: left;\">the scope of the work,<\/li><li style=\"text-align: left;\">the completion deadline,<\/li><li style=\"text-align: left;\">the way the contract is performed,<\/li><li style=\"text-align: left;\">the remuneration,<\/li><li style=\"text-align: left;\">other terms of the contracting authority may concern, among other things, completion deadlines, the scope of work performed, acceptance, remuneration, additional works, contractual penalties or liability for
